Das OLG Braunschweig hat entschieden, dass trotz Vereinbarung eines Gew\u00e4hrleistungsausschlusses zwischen K\u00e4ufer und Verk\u00e4ufer eines Hauses erheblicher Sch\u00e4dlingsbefall in den Balken des Geb\u00e4udes einen Mangel darstellen kann, der zum R\u00fccktritt berechtigt.<\/p>\n<\/div>\n<\/div>\n<div class=\"docLayoutText\">\n<div class=\"docLayoutMarginTop\">\n<p>Der Kl\u00e4ger hatte ein Fachwerkhaus gekauft, das einen massiven Insekten- und Pilzbefall aufwies. Er begehrte vom Verk\u00e4ufer R\u00fcckerstattung des Kaufpreises bei R\u00fcck\u00fcbertragung des Grundst\u00fccks \u2013 trotz des zwischen den Parteien vereinbarten Gew\u00e4hrleistungsausschlusses. \u00dcber den Sch\u00e4dlingsbefall hatte der Verk\u00e4ufer den K\u00e4ufer vor dem Vertragsschluss nicht aufgekl\u00e4rt.<\/p>\n<p>Das OLG Braunschweig hat entschieden, dass der K\u00e4ufer zum R\u00fccktritt berechtigt ist.<\/p>\n<p>Nach Auffassung des Oberlandesgerichts h\u00e4tte der Verk\u00e4ufer den K\u00e4ufer ohne Nachfrage des K\u00e4ufers aufkl\u00e4ren m\u00fcssen.
